Terms & Conditions of Sale – World Marketing Services Limited

  1.  Retention of Title
    Goods sold under this order shall remain the property of World Marketing Services Limited until the price has been paid in full and cleared. Until full payment is received, the client shall not sell, pledge, or otherwise dispose of the goods without the prior written consent of World Marketing Services Limited.
  2. Right to Refuse Orders
    World Marketing Services Limited reserves the right to refuse any order, in whole or in part, at its sole discretion and is not obliged to provide reasons for such refusal. In such cases, any amounts already paid for refused items will be refunded.
  3. Installation (Where Applicable)
    Where the order includes installation, the client shall ensure reasonable access, availability of services (e.g. water, electricity), and a safe environment for the installation.
    Failure or delay in installation due to circumstances beyond the control of World Marketing Services Limited (including lack of access, structural issues, or client unavailability) does not void or invalidate this agreement.
  4. Limitation of Liability
    1. World Marketing Services Limited shall not, under any circumstances, be liable for any indirect, consequential, or loss of profit/downtime damages. 
      Its responsibility shall, in all cases, be limited exclusively to the repair or replacement of the products sold, in line with the terms and conditions of the applicable warranty.Normal wear and tear, misuse, negligence, improper installation by third parties, and lack of maintenance are excluded from the warranty.
    1. Used in accordance with the instructions in the user manual and any recommendations given by World Marketing Services Limited, and
    1. Not modified, tampered with, or repaired by unauthorised third parties.
  5. Warranty & Proper Use
    The warranty is valid only if the product is:
  6. Place of Sale & Promotions
    Sales under this order are deemed to be concluded at any showroom or sales point authorised by World Marketing Services Limited.
    Orders processed through such authorised channels are entitled to benefit from any valid promotions or offers applicable at the time of purchase, subject to the specific terms of those promotions.
  7. Payments, Deposits & Charges
    Amounts paid (including deposits and part-payments) may include administrative and processing charges and are not refundable, except where otherwise required by law or expressly agreed in writing by World Marketing Services Limited.
    Any outstanding balance must be settled by the agreed date and according to the payment terms stated on the order/invoice.
  8. Acceptance of Products / Cancellations & Changes to Orders
    Any request for cancellation or modification of an order must be made in writing.
    Acceptance of such requests is at the sole discretion of World Marketing Services Limited and may be subject to cancellation or modification fees to cover costs already incurred (including transport, installation preparation, or special orders). 
    Use of the product and/or the breaking of any seal, packaging, or protective wrapping shall be deemed to constitute full acceptance of the product as delivered.
    Once the product has been used or its seal has been broken, the order may no longer be cancelled, and any return or replacement will only be considered in line with the applicable warranty terms and any mandatory consumer law provisions.
  9. Use of Personal Data
    The client’s personal data provided in connection with this order will be used by World Marketing Services Limited solely for the purposes of processing the order, delivering and installing the products (where applicable), providing after-sales and warranty services, and for related administrative communications. Data will be handled in line with applicable data protection laws.
  10. Communication & Updates
    All communication regarding this order, including requests for updates, changes, or complaints, should be made by email to frontdesk@worldmarketing.net, clearly quoting the order number.
    Verbal communication (including telephone calls) should always be followed up in writing for proper tracking.
  11. Governing Law & Jurisdiction
    This agreement is governed by the laws of Malta. Any dispute arising in connection with this order shall be subject to the exclusive jurisdiction of the competent Maltese courts and tribunals.
